Terms of Service

These Terms of Service ("Terms") govern your access to and use of the NexaCOD COD Management System (the "Service"), operated by NexaCOD ("us", "we", or "our"). Please read these Terms carefully before using the Service.

1. Agreement to Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service. The creator of the first account and shop for a business entity is considered the "Super Admin" and is responsible for all activity within that account.

2. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

3. User Responsibilities and Your Data

You are solely responsible for the data you and your team members input into the Service, including but not limited to lead information, order details, and financial records ("Your Data"). You represent and warrant that you have all necessary rights and permissions to use and share Your Data on the Service.

You agree not to use the Service to collect, manage, or process any sensitive personal information that is not strictly necessary for the purpose of cash-on-delivery order fulfillment.

4. Prohibited Activities

You may not access or use the Service for any purpose other than that for which we make the Service available. As a user of the Service, you agree not to:

• Use the Service in any way that violates any applicable national or international law or regulation.
• Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
• Attempt to impersonate another user or person or use the username of another user.
• Interfere with, disrupt, or create an undue burden on the Service or the networks or services connected to the Service.

5. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of NexaCOD and its licensors. Our trademarks may not be used in connection with any product or service without the prior written consent of NexaCOD.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the operation of our Service or the information, content, or materials included therein. You expressly agree that your use of the Service is at your sole risk.

8. Limitation of Liability

In no event shall NexaCOD, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Morocco, without regard to its conflict of law provisions.
